    PLEASE NOTE THE SPECIAL BIDDING INSTRUCTIONS ON TRACTS 2, 3, 4, & 5  

    The scheduled closing time on Tracts 2, 3, 4 & 5 will be automatically extended when any one of the tracts receives a bid in the last 5 minutes and will close simultaneously when none of the tracts receives a bid for 5 minutes. This will allow bidders to monitor each tract without the fear of missing out on any one tract.

    BID INCREMENT

    The bidding increments will be $50 per acre. The final sale value will be calculated on a per acre basis times the highest bid received on each tract


    BIDDING PROCESS:

    You may place bids on this farm beginning February 16.  Bidding concludes on March 2. This unreserved online auction features bidding extensions. If a bid is received within five minutes of the scheduled ending time, the bidding period is automatically extended for five more minutes. The extension process will continue until there is a five-minute period where no bids are placed. NOTE: Do not wait until the last day of the auction to register to bid online. All bidders must be approved to bid.  Register at least 24 hours prior to the last auction day or call 402-564-3369 for assistance.

     

    LEGAL DESCRIPTION:

    Part of the NE ¼ East of the River in Section 36 Township 2 South, Range 5 West of the 6th P.M., Republic County.  See web site www.bigironrealty.com for the Informational Title Report No. 4788 for the exact legal description and Certificate of Survey.


    WATER RIGHTS:

    File 2,806 authorizes 45 AF/year at 975 GPM on 75 Acres.  This file overlaps in place of use with File 46,868.

    File 46,868 authorizes 31 AF/year at 975 GPM on 75 Acres limited to a total quantity of 67 AF combined with file 2,806.  This file is subject to Minimum Desirable Streamflow (MDS).

     

    The land is irrigated with a T&L 9 tower center pivot.  The pivot has 11.2-24 tires.   Water is pumped from the Republican River through a river screen with electric motor and turbine pump.  There is close to ½ mile of river frontage.  The pivot windshield wipes.  The land is currently seeded to alfalfa.  There is excellent hunting and recreation access with Tract 4.

    Terms


    The successful high buyer will be notified by a BigIron Realty agent after the conclusion of the online auction. The buyer will be required to enter into a written purchase agreement with 15% down payment to be paid with a check or bank wired within 48 hours after the auction to Republic County Title Company, who will be acting as the closing agent. The balance will be due at closing on or before April 2, 2018. Buyer will receive full possession on the date of closing.
    Seller will provide marketable title to the buyer evidenced by Title Insurance. Cost of Title insurance and escrow closing fees will be split between the seller and the buyer. The 2017 real estate taxes will be paid by the Seller and 2018 Real Estate Taxes and Irrigation Special Assessments on applicable tracts will be paid by the Buyer.
    All Tracts will be sold subject to right of ways and easements and restrictions of record. Please review the Information Title Reports for each tract of land. Reports are available on www.bigironrealty.com. All Acreage figures and tax information has been provided from reliable sources but are not guaranteed.     Each Bidder will be responsible for doing their own inspection of the real estate and personal property. The irrigation equipment was used in 2017 and was in working condition, however, all equipment will sell “as is, where is.” Neither the Seller or BigIron Realty, its agents or representatives, are making any warranties, either expressed or implied.
    Property will not be sold subject to financing. Please have all financial arrangements made prior to the auction. The written purchase agreement to be signed by the seller and buyer after the auction is the sole and controlling document of this sale and supersedes any and all other terms whether verbal, written, expressed or implied and shall be the sole and controlling document for this real estate transaction.
